Terms of Service

1. Acceptance of Terms

By registering for or using ArchPay ("the Platform"), you agree to these Terms of Service. If you do not agree, you may not use the Platform. These terms form a binding agreement between you and Archie Tech ("us", "we").

2. Platform Description

ArchPay is an M-Pesa payment aggregation platform that enables businesses to accept and disburse payments via Safaricom's M-Pesa APIs (STK Push, B2C). We act as a payment facilitator and are not a licensed bank or financial institution.

3. Eligibility

• You must be 18 years or older to use the Platform
• You must be a registered business or individual operating a lawful business
• You must not be on any sanctions list or involved in prohibited activities

4. Account & API Keys

• You are responsible for all activity under your account
• API keys must be kept confidential — do not expose them in client-side code or public repositories
• We reserve the right to suspend accounts that violate these terms without notice
• One account per business entity; sharing accounts between unrelated businesses is prohibited

5. Credits & Payment

• Transaction processing requires a positive credit balance in your account
• Credits are deducted per transaction based on the published fee schedule at /pricing
• New accounts receive 10 free service credits upon registration
• Credits are non-refundable once consumed
• Top-up credits are non-refundable after purchase (contact support within 24 hours for billing errors)

6. Acceptable Use

You must not use ArchPay to process payments for:

• Illegal goods or services under Kenyan law
• Gambling, adult content, or weapons
• Pyramid schemes, Ponzi schemes, or fraudulent activities
• Money laundering or terrorism financing

7. Transaction Processing

We transmit your payment requests to Safaricom. Transaction success or failure is determined by Safaricom's systems — we cannot guarantee that every STK Push will result in a completed payment (customers may cancel or have insufficient funds). Failed transactions do not consume credits.

8. Webhooks & Callbacks

You are responsible for ensuring your webhook endpoint is accessible and responds within 5 seconds. We will attempt callback delivery up to 3 times for failed webhook calls.

9. Limitation of Liability

ArchPay is provided "as is". We are not liable for: Safaricom downtime, lost transactions due to network issues, or any indirect/consequential damages. Our total liability is limited to the credits in your account at the time of the incident.

10. Termination

Either party may terminate the service relationship at any time. Upon termination, your data is retained for 7 years per Kenyan financial regulation requirements, then deleted.

11. Governing Law

These terms are governed by the laws of Kenya. Disputes will be resolved in the courts of Nairobi, Kenya.

12. Changes to Terms

We may modify these terms with 14 days' notice via email. Continued use after the notice period constitutes acceptance.
